These Terms and Conditions govern access to and use of alexandresilva.ue, as well as the commissioning of services provided by Alexandre Silva, a Digital Artist, Web Designer, 3D Artist, AI Artist and Creative Technologist based in Porto, Portugal.
By using this website, requesting a quote, commissioning a service or purchasing a digital product made available through the website, you confirm that you have read, understood and accepted these terms.
1. Available services
The services presented on the website may include, among others, web design, WordPress website development and maintenance, graphic design, branding, creative direction, digital content creation, digital art, AI-assisted or AI-generated creative content, 3D, visualisation, motion graphics, video, creative consulting and technical support for digital projects.
The availability, scope, deadlines, price and deliverables for each service are defined case by case in a proposal, quotation, invoice, contract, confirmation email or specific service page.
2. Requests, proposals and commissioning
Requests sent through the website, by email, through contact forms or other channels do not automatically constitute acceptance of a project. A project is only considered confirmed when the proposal has been expressly accepted and, where applicable, the deposit, booking fee or first agreed payment has been received.
Proposals may include work phases, estimated dates, required materials, number of revisions, payment conditions and approval criteria. Unless otherwise stated, deadlines depend on the timely delivery of content, feedback, access details and decisions by the client.
3. Client content and responsibilities
The client is responsible for providing text, images, brands, logos, credentials, reference materials and any other content required for the project, confirming that they have the right to use them. When the client provides materials protected by copyright, trademarks or third-party rights, the client confirms that the necessary permissions have been obtained.
Alexandre Silva may support the creation, adaptation or optimisation of content, but final validation of commercial, legal, technical, medical, financial, institutional or regulatory information remains the client’s responsibility.
4. Revisions, changes and additional work
Each project includes only the revisions and changes described in the agreed proposal. Requests outside the original scope, substantial changes after approval, new features, new pages, new design assets, urgent requests or changes in creative direction may require an additional quote and timeline adjustment.
5. Payments
Prices, applicable taxes, payment dates, deposits, instalments and invoicing terms are indicated in the proposal, invoice or product/service page. Unless otherwise agreed in writing, work may be suspended when overdue amounts remain unpaid.
For phased services, delivery of final files, publication, transfer of ownership or final access may depend on full payment of the agreed amounts.
6. Digital products, personalised content and started services
Some services and products available on the website may consist of digital content, downloadable files, creative assets, consulting, sessions, automations, websites, design pieces, images, videos, 3D models or other personalised deliverables.
When a personalised service has already started at the client’s request, or when digital content has been made available immediately with the client’s consent, cancellation, return or refund limitations may apply in accordance with applicable law and the Refund Policy.
7. Artificial intelligence and external tools
Some projects may use artificial intelligence tools, automation, creative software, stock libraries, hosting platforms, plugins, cloud services or third-party integrations. Where relevant, their use will be framed within the creative and technical process of the project.
AI-assisted or AI-generated outputs may require curation, editing, human validation and adaptation to the client’s context. It is not guaranteed that outputs generated by external tools will be exclusive, free from similarities with other outputs, or suitable for every use without additional review.
8. Intellectual property
Unless otherwise agreed in writing, rights over concepts, unapproved proposals, working files, methods, reusable components, base code, presets, internal systems and know-how remain the property of Alexandre Silva.
After full payment of the agreed amounts, the client receives usage rights over the final deliverables for the purposes defined in the proposal. Software licences, plugins, fonts, images, 3D models, music, external services or other third-party assets remain subject to their respective licence terms.
9. Portfolio and promotion
Unless there is a confidentiality agreement or written request to the contrary, Alexandre Silva may present completed work in his portfolio, website, social media, commercial proposals or professional presentations, without disclosing confidential client information.
10. Confidentiality
Non-public information shared by the client for the execution of a project will be handled with care and used only for purposes related to the contracted service. The client should identify in advance any information that is especially sensitive or confidential.
11. Website availability and external links
The website may contain links to third-party websites, tools or services. Alexandre Silva does not control and is not responsible for the content, policies, availability or practices of those third parties.
12. Limitation of liability
Services are provided with professional diligence, attention to detail and in accordance with the agreed scope. However, unless expressly guaranteed in writing, no specific commercial results, search engine rankings, sales volumes, audience growth, campaign performance or complete absence of failures in third-party services are guaranteed.
13. Data protection
The processing of personal data in connection with the website and services is described in the Privacy Policy and Cookie Policy.
14. Changes to these terms
These Terms and Conditions may be updated to reflect changes to services, processes, technologies or legal requirements. The version published on this page is the version currently in force.
15. Applicable law and dispute resolution
These terms are governed by Portuguese law. In the event of a dispute, the parties will seek to resolve the matter directly and amicably before resorting to the applicable legal mechanisms.
